Recent rumors that state prosecutor Abdurrahman Yalcinkaya, who in March filed a closure case against the Justice and Development Party (AK Party), will launch another closure case against the party are mostly being dismissed by experts.

Yalcinkaya’s lawsuit filed with the Constitutional Court asserted that the AK Party had become a focal point of anti-secular activity.

Following deliberations, the Constitutional Court announced less than two weeks ago that the AK Party would not be shut down, but it reduced by half its share of state subsidies given annually to all political parties in Turkey.

A former Supreme Court of Appeals chief prosecutor claimed that Yalcinkaya had recently planned to file charges against the AK Party once again.

However, a senior AK Party member with a background in law who asked not to be named, commented that this is nearly impossible.

The AK Party member stated that in order for the chief prosecutor to re-instate the charges, he would have to compile completely new evidence to submit to the Constitutional Court.

“It is impossible for the prosecutor to reuse any piece of information, evidence or documents used in the earlier case,” the same person noted.

“The chief prosecutor can press charges again so long as he does not use any of the documents used in the earlier case.”
